Liability Waiver

I am joining the Coastal Ecosystems Research Foundation (hereafter CERF) for a seven day research adventure. I understand that the group's primary activity is biological research. I am aware that this is the fifth season this project has been run in Queen Charlotte Sound and appreciate that the distribution of the animals is not yet fully known, meaning that sightings can not be guaranteed.

I understand that CERF has no control over the weather. I agree that safety comes first, and to allow the permanent crew to make final decisions regarding the weather. I realise that it may be impossible to deliver me to Port Hardy on Friday evening as planned and absolve CERF and its agents from any responsibility for expenses or missed connections arising from such an impossibility. I understand also that if necessary, my session may have to be terminated early if Friday's forecast does not look good. Likewise, I understand and accept that it may be impossible to fly me out on Saturday afternoon from Port Hardy - in such circumstances, instructions will be awaiting me at the Pacific Coastal Airlines counter at Port Hardy airport.

I am joining the crew for the duration of my stay, and as such share the responsibility for the safety of all : if I notice anything I find to be amiss, I will notify one of the permanent crew immediately, so that the trouble may be rectified before it becomes a problem.

I am aware that I am partaking in a sailing and wilderness adventure and assume all the risks inherent thereto. I understand that CERF will attempt to minimise such risks by providing capable guides with knowledge of local sea and weather conditions and experience in rescue and first aid treatment. I realise that CERF carries no insurance for damage to or loss of my personal equipment, and I have adequate medical insurance (non-BC residents check your coverage for BC). I agree to bear all costs of rescue or medical attention rendered to me (including if necessary air evacuation), arising from my participation in the research adventure.

Waiver and Release of Liability

In consideration of being allowed to participate in any way in the Coastal Ecosystems Research 
Foundation's Central Coast Cetacean Project, related events and activities, the undersigned 
acknowledges, appreciates, and agrees that:

The risk of injury from the activities involved in this program is significant, including the 
potential for permanent paralysis and death, and while particular rules, equipment, and personal 
discipline may reduce this risk, the risk of serious injury does exist; and,
I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE 
NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
I willingly agree to comply with the stated and customary terms and conditions for 
participation. If however I observe any unusual significant hazard during my presence of 
participation, I will remove myself from participation and bring such to the attention of the 
nearest official immediately; and,
I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, 
HEREBY RELEASE AND HOLD HARMLESS the Coastal Ecosystems Research Foundation, its officers, 
officials, agents and/or employees, other participants, sponsoring agencies, advertisers, and, if 
applicable, owners and lessors of premises used to conduct the event ("Releasees"), WITH RESPECT TO 
ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY 
THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.


I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS 
TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND 
VOLUNTARILY WITHOUT ANY INDUCEMENT.

This is to certify that I, as parent/guardian with legal responsibility for this participant, do 
consent and agree to his/her release as provided above of all the Releasees, and, for myself, my 
heirs, assigns and next of kin, I release and agree to indemnify the Releasees from any and all 
liabilities incident to my minor child's involvement or participation in these programs as provided 
above.
